Circumvention immediately voids your order. *Conditions apply - of which you’ll be informed. ·(Ownership of the Goods): The Customer agrees: A-that the title of the Goods remain the property of Twista Industries until full payment has been received and cleared by the Agent or any other party which may be appointed from time to time; B-to protect the interests of Twista Industries and must not do anything which may prejudice or be inconsistent with those interests, including but not limited to any attempt to sell, dispose of, or grant any interest over or encumbrance over the Goods. ·(Quotation and Payment): The Customer agrees: A-that the final quotation amount will be determined on the date of the site inspection and accepted by the Customer; B-to pay in accordance with the “How to Pay” section of this Agreement. ·(Installation): The Customer acknowledges that: A-Twista Industries and the Supplier/Installer accept no responsibility for any pre-existing damage to the roof or any consequential damage sustained during installation due to the wear and tear or state of repair of the roof including but not limited to any water leaks due to roof damage or penetration of the roof sarking membrane; B-the product warranty of any product supplied by Twista Industries may be void due to pre-existing roof damage; C-the product warranty of any product supplied by Twista Industries is limited to 12 months for those products where the products have been: (1) installed or located within or in the vicinity of: (i) a swimming pool; (ii) bathroom; (iii) vents or exhaust fans situated in the roof of the Customer’s property; or (2) installed on the Customer’s property situated within 10 kilometres of a coastal area; D-the responsibility for the site in relation to the installation of the products is held with the Installer absolutely and is considered to be the “site controller” as defined under all Occupational Health & Safety legislation or similar legislation throughout Australia. ·(Exclusion of Liability): To the extent permitted by law, Twista Industries and Twista Call Centre exclude all liability for any claim, loss, damage or injury sustained to any person or property as a result or in connection with the supply and installation of the Goods. ·(Interpretation): In this Agreement, the following words have the following meaning: “Customer” means the details contained in the Customer box in the Agreement. “Goods” means the details contained in “THE WORKS” box in the Agreement. “Supplier/Installer” means the details contained in the Supplier/Installer box in the Agreement. “Twista Call Centre” means Twista Call Centre Pty Ltd ABN 23 134 792 859 and includes any of its successors or assigns. “Twista Industries” means Twista Industries Pty Ltd ABN 59 097 637 959 and includes any of its successors or assigns. “Tax Invoice/Sales Agreement” means the Agreement. E-the Customer acknowledges and grants to Twista Industries the right to: (a) photograph or create any image of the Customer’s roof and home on which a Twista Product has been installed; and (b) deal with the photograph or image created at its absolute discretion for any commercial or business use. F-at the time of entering into this Agreement, it made representations and warranties that it is solvent and able to meet any payment obligations under the terms of this Agreement |
